# Terms of Service These Terms of Service govern your use of the StayBird website and your booking of our hotels, serviced apartments, villas and event venues. By using our website or making a booking, you agree to these terms. ## Who can book You must be at least 18 years old and able to enter into a binding contract under Indian law to make a booking. You are responsible for the accuracy of the details you provide. ## Bookings and confirmation A booking is confirmed only after we accept it and payment succeeds, and you receive a confirmation from us. We may decline or cancel a booking in cases such as suspected fraud, an obvious pricing error, unavailability or non-compliance with these terms. ## Prices, taxes and GST Prices are shown in Indian Rupees. Before you pay, we show the total price as a single figure together with a break-up of mandatory charges, including Goods and Services Tax (GST). GST is charged as per prevailing government rates. For hotel rooms these currently depend on the room tariff per night, so the exact rate is shown at checkout. We issue a GST tax invoice for your booking. Rates can change over time, but the rate confirmed for your booking is the rate that applies to that booking. ## Payment Payments are processed securely by our payment partner at the time of booking. We do not store your full card or bank details. The amount payable is always the amount displayed and charged by us; it cannot be set by you. ## Check-in, check-out and ID Standard check-in is from 2:00 PM and check-out is by 11:00 AM, unless stated otherwise for a specific property. Early check-in and late check-out are subject to availability and may carry a charge. At check-in, every guest must present a valid government-issued photo ID, as required by law. We may refuse check-in where valid ID is not provided. ## Guest conduct and property rules You agree to use our properties responsibly, to respect other guests and staff, and to follow property rules, including rules on capacity, smoking, pets, noise and events. You are responsible for any loss or damage caused by you or your guests. We may ask guests to leave for unlawful or unsafe behaviour, without a refund. ## Cancellations and refunds Cancellations and refunds are governed by our Cancellation and Refund Policy, which forms part of these terms. Some rates and villa or event bookings may carry their own cancellation terms, which are shown at the time of booking and will apply to that booking. ## Use of the website You may use our website only for lawful purposes. You agree not to misuse it, attempt to gain unauthorised access, disrupt it, or copy its content without permission. All content, branding and images on the site belong to StayBird or its licensors and are protected by law. ## Third-party links Our website may link to third-party sites and services, such as maps and our payment partner. We are not responsible for the content or practices of those third parties. Their use is governed by their own terms and policies. ## Limitation of liability We take care to provide accurate information and a good experience, but to the extent permitted by law our liability for any booking is limited to the amount you paid for that booking. We are not liable for indirect or consequential losses, or for events outside our reasonable control. ## Force majeure We are not responsible for failure or delay caused by events beyond our reasonable control, including natural events, severe weather, government action, strikes, utility or network failures, or public health measures. ## Governing law and disputes These terms are governed by the laws of India. Subject to the dispute resolution and grievance process below, the courts at Pune, Maharashtra have jurisdiction.
